Welcome to Rua by Amna! The terms “we”, “us” and “our” refer to Rua by Amna. Rua by Amna operates this website and store, including all related information, content, features, tools, products and services, to give you, the customer, a curated shopping experience (the “Services”).

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use or access our Services.

SECTION 1 — ACCEPTANCE OF TERMS

By using our website and Services, you agree to these Terms of Service. If you do not agree, please do not use our site. We may update these Terms from time to time, and your continued use of the site after changes are posted constitutes your acceptance of the revised Terms. We recommend checking this page periodically.

SECTION 2 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least 18 years old, or are using the Services under the supervision of a parent or legal guardian.

To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is correct, current and complete, and that you have the right to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.

SECTION 3 — OUR PRODUCTS

We make every effort to accurately represent our products, including descriptions, pricing, and images. However, colours or product appearance may differ slightly from your screen due to your device and display settings, and we do not warrant that products will exactly match how they are depicted online.

All product descriptions and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product, limit quantities, and limit sales to any person, geographic region, or jurisdiction, on a case-by-case basis.

SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, at our discretion, and your order is not accepted until we confirm it. We must receive and process your payment before an order is accepted.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order is confirmed. If we do not accept, need to change, or cancel your order, we will attempt to notify you using the email, billing address, and/or phone number provided at the time of order.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent that your purchases are for your own personal use, and not for commercial resale.

SECTION 5 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation. Unless stated otherwise, posted prices do not include shipping and handling charges, which are shown separately at checkout.

We may run promotions from time to time governed by their own terms; if there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase and payment information, and to promptly update your account details (including your email address and payment details) so we can complete your transactions and contact you as needed. You represent that any payment information you provide is true and complete, that you are authorised to use the payment method provided, and that you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

SECTION 6 — SHIPPING AND DELIVERY
  • Delivery Estimates: We ship across India via India Post Parcel and DTDC as our primary courier partners, with EMS Speed Post used only for urgent or secure dispatches on request. Estimated delivery is 2-5 business days intrastate (within Kerala) and 5-8 business days interstate (rest of India) via India Post or DTDC; EMS Speed Post typically delivers in 3 business days intrastate and 5 business days interstate. Full details are set out in our Shipping Policy. These are estimates only and are not guaranteed — we are not liable for delays caused by courier partners, weather, or other events outside our control.
  • Shipping Charges: Shipping costs are calculated based on your delivery address and displayed at checkout before payment.
  • Once we hand a product to our shipping carrier, risk of loss for that product passes to you; if a package is lost or damaged in transit, please contact us so we can assist you with the carrier.
SECTION 7 — RETURNS AND REFUNDS
  • Return Window: We do not offer returns or exchanges for reasons such as change of mind, incorrect size selection, or personal preference. Returns are accepted only if you receive a damaged, defective, or incorrect product, and must be requested within 48 hours of receiving your order, along with photo/video proof of the damage. Eligible products must be returned in their original condition, packaging, and tags.
  • Refund Processing: Once a returned product is received and inspected and the claim is approved, refunds will be processed within 7-15 business days to your original payment method.

SECTION 8 — INTELLECTUAL PROPERTY

Our Services — including all trademarks, brand names, text, images, graphics, product photography, and the design, selection, and arrangement of the Services — are owned by Rua by Amna or its licensors and are protected under Indian and applicable international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Unauthorised use may violate applicable intellectual property laws. All rights not expressly granted here are reserved by Rua by Amna. The “Rua by Amna” name, logo, and related marks are our trademarks and must not be used without our prior written permission.

SECTION 9 — USER CONDUCT AND PROHIBITED USES

You agree to use the Services for lawful purposes only, and not to:

  • violate any applicable law, regulation, or third party’s rights (including intellectual property rights);
  • harass, abuse, defame, or harm any other person, including our employees;
  • transmit false or misleading information, or impersonate any person or entity;
  • upload or transmit viruses, malware, or any code intended to disrupt or damage the Services;
  • attempt to gain unauthorised access to the Services, other users’ accounts, or our systems;
  • reproduce, duplicate, sell, resell, or exploit any portion of the Services without our permission;
  • collect or track others’ personal information, or spam, phish, pretext, spider, crawl, or scrape the Services; or
  • interfere with or circumvent the security features of the Services.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated these Terms.

SECTION 10 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

The Services may give you access to third-party tools (such as our payment gateway) or contain links to third-party websites that we do not monitor or control. We provide access to such tools and links “as is” and “as available,” without any warranty or endorsement, and we have no liability arising from your use of them. Your use of any optional third-party tool or website is entirely at your own risk and subject to that third party’s own terms. Complaints regarding third-party products or services should be directed to the third party.

SECTION 11 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.

SECTION 12 — FEEDBACK

If you submit any ideas, suggestions, reviews, or other feedback (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute that Feedback for any purpose, including commercial use. We are under no obligation to keep Feedback confidential, compensate you for it, or respond to it. You are solely responsible for your Feedback and agree it will not violate any third party’s rights or contain unlawful, abusive, or infringing material.

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any such errors and to change, update, or cancel orders based on inaccurate information at any time, without prior notice, including after you have submitted an order.

SECTION 14 — DISCLAIMER OF WARRANTIES

The Services and all products offered through them are provided “as is” and “as available,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

SECTION 15 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Rua by Amna, and our partners, directors, officers, employees, affiliates, agents, contractors, and service providers, shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, or loss of data — arising from your use of the Services or any product procured through them, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

SECTION 16 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rua by Amna and our affiliates, partners, officers, directors, employees, agents, contractors, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of (1) your breach of these Terms, (2) your violation of any law or a third party’s rights, or (3) your access to and use of the Services. We will notify you of any such claim, and we may control its defence and settlement, at your expense, though we will not settle any claim requiring a non-monetary obligation from you without your consent.

SECTION 17 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

SECTION 18 — TERMINATION

We may terminate this agreement or your access to the Services, in our sole discretion, at any time and without notice, and you will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law — will continue to apply.

SECTION 19 — ASSIGNMENT

You may not transfer or assign these Terms or any of your rights under them without our prior written consent; any attempt to do so will be void. We may transfer or assign these Terms and our rights and obligations under them without notice to you.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with any policies referenced here, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications (including earlier versions of these Terms). Any ambiguity in interpreting these Terms will not be construed against the party that drafted them.

SECTION 21 — GOVERNING LAW

These Terms of Service, and any separate agreements under which we provide you Services, shall be governed by and construed in accordance with the laws of India.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting the revised version to our website. It is your responsibility to check this page periodically. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
